1. Introduction and acceptance

These Terms and Conditions (“Terms”) govern access to and use of the website and laboratory services of FOV Labs, an Arizona company (“FOV Labs,” “we,” “us,” or “our”), by business clients including environmental consultants, remediation contractors, industrial hygienists, and other professional users (“Client,” “you”). By accessing our website, creating an account, placing an order, or submitting samples, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our website or services.

 

2. Scope of services

FOV Labs provides laboratory analysis of environmental samples for mold (including but not limited to air, surface, and bulk samples) and issues analytical reports describing the presence and types of mold detected in the samples submitted. Our services are limited to laboratory testing of the specific samples we receive and do not include site inspections, remediation services, or full indoor air quality investigations.

Analytical results and reports relate solely to the samples tested and to the conditions at the time of sampling, which are outside our control. Our reports do not certify that any property is safe, habitable, compliant, or free of mold or other contaminants.

 

3. Intended users

Our website and services are intended for use by business and professional clients such as environmental consultants and remediation companies, not by individual consumers for personal use. By using our services, you represent that you are acting in a professional or business capacity.

 

4. Ordering, samples, and client responsibilities

4.1 Order placement
Orders may be placed through our website, by submitting a completed chain‑of‑custody form, by email, or as otherwise agreed in writing. We may require a valid purchase order or written authorization before beginning work.

4.2 Sampling and shipping
Client is solely responsible for selection, collection, labeling, packaging, preservation, and shipment of samples, including compliance with all applicable sampling protocols, carrier requirements, and hazardous materials regulations.

4.3 Sample suitability and rejection
We may inspect and reject, return, or apply special handling and disposal fees to samples that are improperly collected, inadequately labeled, damaged, leaking, or otherwise unsafe or unsuitable for analysis. If samples are unusable or incomplete, we may request recollection or cancel the order for those samples.

4.4 Hazard disclosure
Client must disclose any known or suspected hazardous characteristics of samples. Client remains responsible for any harm arising from failure to properly disclose or package such samples.

 

5. Reports and use of results

5.1 Content of reports
Our reports typically identify the mold types detected, provide relevant observations about the samples, and describe analytical methods used. We may, at our discretion, provide reference or comparison information, but we do not interpret results in the context of building codes, legal standards, or specific health thresholds unless expressly agreed in writing.

5.2 Intended beneficiaries
Reports are prepared for the sole use and benefit of the Client that ordered the services and may not be relied upon by any other person or entity without our prior written consent.

5.3 Limitations on use
Client is responsible for interpreting results and communicating them to its own clients. Reports do not constitute recommendations regarding remediation methods, project scope, or clearance decisions.

 

6. No medical, legal, or regulatory advice

FOV Labs does not provide medical, legal, or regulatory advice. Test results and any information on this website are provided for informational purposes only and are intended for use by qualified professionals. They are not a substitute for professional medical advice, diagnosis, or treatment.

You must not rely on our reports or website content to make medical or legal decisions. You should consult a licensed healthcare provider regarding any health‑related questions and appropriate legal or regulatory professionals for compliance issues.

 

7. Turnaround times and service interruptions

We offer same‑day turnaround for most standard mold analyses when samples are received by the published cut‑off time; however, all turnaround times are estimates only and are not guaranteed. Actual turnaround may vary based on sample volume, complexity, and other operational factors.

We are not liable for delays caused by events beyond our reasonable control, including but not limited to equipment failure, supply shortages, carrier delays, power or network outages, labor disruptions, or natural disasters.

 

8. Pricing, invoicing, and payment terms

8.1 Pricing
Unless otherwise agreed in a separate written agreement, our fees are determined by our current price list, quote, or proposal at the time of order. We may update pricing at any time for future work.

8.2 Invoicing
Unless stated otherwise in a written agreement, invoices are due at the time of service. We may send invoices electronically to the contact details you provide.

8.3 Late payment; suspension
We may charge late fees or interest on overdue balances as permitted by applicable law, and we may withhold reports, refuse new orders, or suspend services until all outstanding amounts are paid. You are responsible for collection costs, including reasonable attorneys’ fees, incurred in recovering overdue amounts.

 

9. Intellectual property and use of our materials

All rights, title, and interest in and to our website, logos, trademarks, method descriptions, report formats, templates, and other content are owned by FOV Labs or our licensors. We grant you a limited, non‑exclusive, non‑transferable license to use your reports internally and for the specific project for which the testing was performed.

You may reproduce reports in full for project‑related purposes but may not publish excerpts or modified versions, or use our name or logo in advertising, expert opinions, or public statements, without our prior written consent.

 

10. Website use and accounts

10.1 Acceptable use
You agree not to misuse our website, including by attempting to gain unauthorized access, interfering with its operation, scraping or harvesting data, or infringing any intellectual property rights.

10.2 Accounts and security
If you create an online account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us promptly of any unauthorized access or security breach. We may suspend or terminate accounts that we believe are compromised or used in violation of these Terms.

 

11. Disclaimers

To the maximum extent permitted by law, the website, services, and reports are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including any warranties of merchantability, fitness for a particular purpose, and non‑infringement.

We do not warrant that the website or services will be uninterrupted, error‑free, or free of harmful components, or that the results will meet your specific requirements.

 

12. Limitation of liability

To the fullest extent permitted by law, FOV Labs will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of business, project delays, or remediation costs, arising out of or relating to the website, services, or reports, even if we have been advised of the possibility of such damages.

FOV Labs’ total aggregate liability arising out of or relating to any services or report shall not exceed the aggregate fees paid to FOV Labs for the specific work order giving rise to the claim.

 

13. Indemnification

Client shall defend, indemnify, and hold harmless FOV Labs and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) Client’s sampling practices, site conditions, or failure to comply with applicable laws; (b) Client’s use or misuse of results or reports; or (c) any breach of these Terms by Client, except to the extent caused by FOV Labs’ gross negligence or willful misconduct.

 

14. Governing law and venue (Arizona)

These Terms and any dispute arising out of or relating to them, the website, or the services shall be governed by the laws of the State of Arizona, without regard to its conflict‑of‑laws principles.

The state and federal courts located in Maricopa County, Arizona shall have exclusive jurisdiction over all disputes arising out of or relating to these Terms or the services, and you consent to the personal jurisdiction and venue of such courts.

15. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using our website or services, you consent to our handling of information as described in the Privacy Policy.

 

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page, and, where required, provide additional notice. Your continued use of the website or services after any changes become effective constitutes your acceptance of the updated Terms.
